A. Window Tech System's marketing policy is to sell to authorized and credit approved consumers of window products.
B. All orders are subject to acceptance based on availability of window parts. Orders may be canceled by Window Tech Systems due to conditions beyond the corporation's control.
C. Window Tech System's prices are subject to change without prior notice. Window Tech Systems reserves the right to invoice window products at the price in effect at the time of shipment.
D. Sales will be conducted on the basis of advanced and/or C.O.D. payments and credit approvals.
E. All window products sold are custom manufactured to order. Lead times are influenced by market activity, availability of window parts, and production capacity. Most orders currently are available for shipment within two to three weeks.
ORDER PLACEMENT
A. All order entry requires a written purchase order. Orders placed at the plant or telephone to Inside Sales must be signed and/or confirmed by mail or facsimile (518-899-4104).
TERMS OF SALE
NO CREDIT APPROVAL
A. Payments of minimum 50% of order value at order entry and the balance due on pick up or delivery.
CREDIT APPROVAL
A. Window Tech Systems credit terms are Net 30 days from date of invoice.
B. A service charge of 1 1/2 % per month will be assessed on all past due invoices.
C. All checks returned to Window Tech Systems by the bank will be subject to a $20.00 service charge.
SERVICE AND ADJUSTMENTS
A. To minimize problem representation, Window Tech Systems will conduct service transactions only with the window customer who purchased the involved window products. Due to legal ramifications, this manufacturer-cutomer channel of business communications must be used. Service requests from the homeowner directly to Window Tech Systems will be referred to the original customer.
B. As identified in Window Tech System's Limited Warranty, the corporation will warrant the window material and workmanship. Defective materials or parts will be replaced by the corporation.
C. Window Tech Systems will not be responsible for window problems associated with installation.
RETURNED PRODUCTS
A. Window products are not to be returned without authorization from Window Tech Systems. Once identified, windows not made to specification may be returned immediately. Windows manufactured to order are not returnable.
CHANGES AND CANCELLATIONS
A. All windows are custom manufactured to order. Changes or cancellations cannot be made once the order has been released from production.
WINDOW TECH SYSTEMS AND COMMON CARRIER DELIVERIES
A. Full freight costs will be allowed provided the windows are delivered on Window Tech Systems trucks within the standard delivery cycle.
B. (1) For window quantities of 25 or more, Window Tech Systems will deliver shipments within a 50 mile radius.
(2) For quantities less than 25 windows in the local market, window consumers are to pick up windows at the Malta plant.
C. All other window shipments will be made freight collect, including UPS charges, unless otherwise stated.
CLAIMS & DAMAGES
A. Claims for damaged windows shipped by common carrier must be filed by the receiving window customer against the transportation company.
B. Shortages or damages in shipments of windows delivered on Window Tech Systems trucks must be reported to the driver at the time of delivery. Errors in shipments are to be reported to Window Tech Systems within five days after receipt of windows.
